Certified
EEO Complaint Processors are equal employment investigators and paralegal
professionals, who possess at least a bachelor’s degree, and extensive
experience and specialized knowledge with Civil Rights Regulations and Human

Processors are not attorneys and they do not provide legal advice.
Typically,
paralegals are called legal assistants because they work for a lawyer and perform many of the same tasks as lawyers.One of the most important tasks for a
paralegal professional is preparatory work; helping lawyers prepare for
hearings, and trials. Paralegals investigate the facts of cases and ensure that
all relevant information is considered. They also identify appropriate laws,
judicial decisions, legal articles, and other materials that are relevant to
assigned cases. After they analyze and organize the information, paralegals may
prepare written reports that attorneys use in determining how cases should be
handled. Paralegals may help prepare the
legal arguments, draft pleadings and motions to be filed with the court, obtain
affidavits, and assist attorneys during trials. Paralegals also organize and
track files of all important case documents.
Paralegals are a value asset to the
legal industry, but they are prohibited from carrying out duties considered to
be the practice of law, such as representing clients, setting legal fees,
giving legal advice, and presenting cases in court.
HOWEVER,
The Code of
Federal Regulations
(CFR) allows complainants in EEO
complaints to be represented by an individual who is not an attorney, which
includes: coworkers, family members, friends, paralegal professionals, and
Certified EEO Complaint Processors. Unfortunately, EEO complainant
representatives are not eligible to receive compensation for legal fees.Pursuant to CFR Section 1614.501(e)(1)(iii), an
attorney who represents himself is not entitled to an award of fees. Neither a
non-attorney nor a federal employee (including attorneys) who represents a
complainant is entitled to an award of fees.
HOWEVER,
The CFRgrants prevailing complainants(i.e.
one who is unrepresented or who is represented by a non-lawyer)compensable “Reasonable
costs” incurred.Costs must be proved in
the same manner as fees are, and the complainant must provide documentation,
such as bills or receipts.
Proficient paralegal professionals
are cost effective because they provide many of the same legal services as
lawyers at a lower cost.Again, Certified EEO
Complaint Processors are not attorneys and they do not provide legal advice,
but they are equal employment investigators and paralegal professionals, who
possess extensive experience and specialized knowledge about Civil Rights
Regulations and Human Rights Issues; and they are available to provide a
variety of consultation services.
